  • A Tale of Two Demonstrations

    Today's hypocrisy is brought to you by Reichstag Minister Peelosi.

    Watch this video, then come back for some questions.

    Okay.

    What was wrong with what you saw?

    What's that you say?  People violating the law by demonstrating in the hallways of Congress.  Well, suppose I spotted you that point.  What should have been done about it?  Arrests?  Prosecutions?  Still, while I might choose otherwise, I can understand your conclusion.  Now.  Most important, for my purposes:  who should the police have arrested?  Or, to rephrase it:  who was demonstrating?

    You may want to review the video.

    I saw folks tearing papers and throwing them on the floor.  Did you?  I saw people dressed in costumes (hospital gowns).  Did you?  I saw people with protest signs.  Did you?  I heard people chanting.  Did you?  Some of them were chanting "health care for all."  Did you hear that?  Some of them were chanting "we won't pay for abortions."  Did you hear that?

    Now.  Again.  Who was demonstrating?  In other words, who should have been arrested for demonstrating, if demonstrating was prohibited by law in that location?

    The way I saw the video, the Capitol Police only arrested anti-health care legislation protestors.  The hospital gown goons were left alone.  Oddly, though they were allowed to have signs INSIDE the Cannon House Office Building, the folks coming to Cannon from the House Call Rally were forced to leave their signs outside.

    Yes indeed.

    This constitutional litigator and instructor in constitutional law hereby certifies that if you watched that video, you watched the violation of the constitutional right to equal protection of the laws.  Please note:  I am not saying that any of the demonstrators had the RIGHT to protest inside the office building (although a fair reading of the Constitution suggests as much).  I am complaining that the Pelosi Police did not equally enforce the law.
